1. Introduction

These Terms of Use (“Terms”) govern your access to and use of AI Baby Premium (the “App”), a mobile application published by WIIN, Ltd. (“Company,” “we,” “us,” or “our”). By downloading, installing, or using the App you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be 18 years of age, or the parent/legal guardian of a child user, to create an account or purchase a subscription. By using the App, you represent that you meet this requirement and that any content depicting a minor is submitted with the consent of that minor’s parent or legal guardian.

3. License

We grant you a limited, non-exclusive, revocable, non-transferable license to install and use one copy of the App on each device that you own or control, solely for personal, non-commercial purposes and in accordance with these Terms and the Apple Media Services Terms & Conditions.

4. Auto-Renewing Subscriptions

  1. Payment & Renewal. Your Apple ID account will be charged at confirmation of purchase and automatically on each renewal date unless auto-renew is turned off at least 24 hours before the end of the current period.

  2. Manage Subscription. Open Settings › Apple ID › Subscriptions to view, change, or cancel at any time. Deleting the App does not cancel a subscription.

  3. Free Trials. If offered, any unused portion of a free trial is forfeited when you purchase a subscription.

  4. Refunds. All billing is handled by Apple; refund requests must be submitted through Apple Support.

5. In-App Currency (“Stars”)

“Stars” unlock AI templates and features. Stars granted by subscription are credited upon successful receipt validation. Stars have no cash value, may not be transferred, and expire when your account is closed.

6. User Content & Face Data

  • Uploads. To generate AI images, you may upload photographs that include faces.

  • Use. We process the images solely to create personalised AI pictures or videos; we do not sell or share face data with third parties.

  • Storage & Retention. Originals are deleted automatically after 30 days; derived embeddings and generated outputs are stored until you delete them in-app.

  • Parental Control. You are responsible for content depicting minors and for supervising your child’s use of the App.

7. Acceptable Use

You agree not to: (a) upload unlawful, sexual, or violent material involving minors; (b) reverse-engineer the App; (c) resell or sublicense any AI output; or (d) use the App to infringe anyone’s rights.

8. Termination

We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your license ends and you must delete the App; sections 6–11 survive.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

Our total liability for any claim arising out of or relating to the App will not exceed the greater of (a) the amount you paid for the subscription in the 12 months preceding the claim or (b) USD 100. We are not liable for indirect, incidental, or consequential damages.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute will be resolved informally first; if unresolved, it shall be submitted to the state or federal courts located in Delaware, and you consent to their jurisdiction.

12. Changes to Terms

We may update these Terms at any time. Material changes will be announced in-app or by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
